Today TNS's Russell Brownlee and Josée Dumont hosted a Mock Trial at the 2024 ITE Canada Conference being held in Hamilton this week. They were joined by several Ontario lawyers who conducted chief and cross examination of expert witness reports for the Plaintiff (motorcyclist) and Defendant (municipal road authority) in a personal injury lawsuit.
The lawsuit was based on a traffic accident and centred on the road authority's legal liability for rural road design and traffic control. Russell and Josée, as expert witnesses, provided professional engineering review of the existing conditions at the accident location and insights into transportation engineering professional judgement, legislation, standards, and industry best practice. The session ended with a judge providing their decision and reasons.
